FBI swoops in to halt return of 'Muslim Mafia' documents
New subpoena in conflict with judge's order on papers captured in undercover investigation

WASHINGTON – While attorneys representing the co-author of "Muslim Mafia" were preparing late today to honor a federal court order to return documents obtained from the Council on American-Islamic Relations in an independent undercover operation, FBI agents served a warrant on a Washington, D.C., law office for the same documents.
The FBI agents entered the capital law offices of Cozen O'Connor tonight and issued a warrant for thousands of pages of documents as well as audio and video recordings gathered by P. David Gaubatz and his son Chris in a daring and lengthy undercover penetration of CAIR in which the younger Gaubatz served as an unpaid intern for the group that was labeled an unindicted terrorist co-conspirator in last year's Holy Land Foundation trial.
CAIR claimed in a lawsuit that Gaubatz removed its papers and made recordings of employees "without any consent or authorization and in violation of his contractual fiduciary and other legal obligations." A federal judge in Washington issued a restraining order Nov. 3 barring the Gaubatzes from further use or publication of the material – 12,000 pages of documents along with audio and video recordings – and demanding that they return it to the Muslim group's lawyers.
However, last night the FBI stepped in with a warrant, suggesting the agency wants to see the papers and examine the recordings as part of its interest in CAIR and its Hamas terrorist links, including those involving its founding chairman and acting executive director.
Joseph Farah, chief executive officer of WND and its subsidiary, WND Books, who has been raising money for the defense of his author and son, welcomed the FBI's interest in the papers.
"Obviously, we were prepared to honor the court order from Judge Colleen Kollar-Kotelly," he said.
Kollar-Kotelly – who as head of the Foreign Intelligence Surveillance Court made several controversial decisions against the Bush administration's counterterrorism policies – was criticized recently by many security experts for ruling against the military's designation of a Guantanamo detainee as an enemy combatant, allowing the Obama administration to send him home.
"Now," said Farah, "we will have to confer with the attorneys to determine what happens next. Which takes precedence – a federal court order or an FBI warrant? I trust this will be sorted out in the days to come. Personally, I would like to see these papers in the hands of trained FBI investigators. The revelations raised about CAIR in 'Muslim Mafia' have clearly piqued the agency's interest."
In fact, adds Farah, "I would say the nature of this warrant and the way it was served strongly suggests the FBI doesn't want these documents returned to CAIR – where they were destined to be destroyed in the first place. We have always believed, as the Gaubatzes did, that there is valuable evidence here vital to the nation's security."
The FBI's grand-jury subpoena is intended to preserve the status quo and not intended to require the Gaubatzes' legal counsel to turn over the documents immediately – or before notifying Judge Kollar-Kotelly.
CAIR contends the documents were stolen. David Gaubatz insists the research described in his book, including securing the documents, "was conducted professionally and legally" in cooperation with law enforcement officials. Much of the relevant material is already in the hands of the FBI, he said.
The Gaubatzes are being represented by high-profile First Amendment specialist Martin Garbus, most famous for representing Daniel Ellsberg in the Pentagon Papers case. Garbus is teamed with Bernard Grimm of Cozen O'Connor in Washington and Daniel Horowitz in the San Francisco Bay area. Horowitz, a frequent TV legal analyst, represented talk-radio host Michael Savage in his lawsuit against CAIR. Grimm also is a regular commentator on the Fox News Channel, CNN and Court TV.
In Gaubatz's book, "Muslim Mafia: Inside the Secret Underworld That's Conspiring to Islamize America," he and co-author Paul Sperry present firsthand evidence CAIR is acting as a front for a well-funded conspiracy of the Muslim Brotherhood – the parent of al-Qaida and Hamas – to infiltrate the U.S. and help pave the way for Saudi-style Islamic law to rule the nation.
In the lawsuit, however, CAIR, a self-described Muslim civil-rights group, does not defend itself against the book's claims.
The FBI cut off ties to CAIR in January after the group was named an unindicted co-conspirator in the Holy Land Foundation case in Texas, the largest terrorism-finance case in U.S. history. Democratic Sen. Charles Schumer of New York and other senators have called for a government-wide ban on CAIR.
Garbus told WND he believes Americans have an interest in exposure of the CAIR documents, because they are relevant to federal law enforcement officials' concerns about the group's ties to terrorist operatives that threaten the nation's security.
"The more information you have, the better able you are to form a judgment about the organization," he said.
Garbus said the Gaubatz lawsuit has similarities to his defense of legal author and CNN commentator Jeffrey Toobin, who allegedly violated a confidentiality agreement with Iran-Contra investigator Lawrence E. Walsh in the early 1990s when he published a book about his experience as a member of the prosecution team. Garbus won the case on First Amendment grounds.
CAIR alleges Chris Gaubatz signed a confidentiality agreement when he worked as an intern for six months, but Gaubatz denies it, and CAIR reportedly says it has no copy of any agreement.
In any event, Horowitz says CAIR has bigger things to worry about: "If a grand jury hears even half of what is in the 'Muslim Mafia,' CAIR will be destroyed and its leaders could face massive prison terms."

Police Department Duped By CAIR
In the new blockbuster book, Muslim Mafia, the authors give an account of how CAIR, working in tandem with a county police officer, helped scuttle a valuable counter-terrorism training program — and left the door wide open for a breach of a classified police database, putting all of us at risk!
Here is a point by point summary of the details from the book that should shock you and make your blood boil!
In other words, this was a case, not of the “fox guarding the henhouse,” but the “fox” (Rasool and CAIR) telling the “farmer” (Chief Rohrer) that the “henhouse” shouldn’t be guarded — because doing so would offend the fox!
This is just ONE example of how government officials, intoxicated with political correctness, have been duped by CAIR.
Here is a point by point summary of the details from the book that should shock you and make your blood boil!
- The Fairfax County (Virginia) Police Department (FCPD) had a training contract for its officers with the Higgins Center for Counter Terrorism Research, which it maintained for several years without complaint.
- Then, at least two Muslim officers on the force complained about the program — one of them a sergeant named Mohammad Rasool.
- CAIR complained as well, claiming the program portrayed Islam in a “bad light.” In fact, CAIR officials had at least two phone conversations to complain about the program with the FCPD’s Chief, David Rohrer.
- In 2006, the FCPD canceled the counter-terrorism training program.
- Also that year, Chief Rohrer spoke at CAIR’s annual fundraising dinner, where he said, “Let us choose tolerance over intolerance, acceptance over prejudice, and understanding over ignorance.”
- Unbeknownst to Rohrer, Rasool was combing through a classified federal police database. Why? Because a fellow Muslim told Rasool he thought he was under surveillance. Rasool’s search through the classified database confirmed that the fellow Muslim was under surveillance. Rasool then tipped him off.
- When agents went to arrest Rasool’s friend, they found him destroying evidence. Knowing they had a mole, agents worked backward and discovered it was Rasool.
- The very counter-terrorism training program CAIR and the two Muslim officers complained about, and Chief Rohrer canceled, was in part designed to help prevent what Rasool did!

CAIR And The Muslim Mafia
A group of investigative reporters have opened the proverbial can of worms for the Council on American-Islamic Relations (CAIR). The investigative team, organized by Dave Gaubatz and including his son, Chris, and a small band of researchers infiltrated CAIR’s national headquarters for six months and spirited away over 12,000 documents and 300 hours of video that has been compiled into a book that clearly demonstrates CAIR’s plan to cripple and destroy the constitution of the United States from within.
While CAIR, predictably, has publically accused the Gaubatz team and three congressional representatives who announced the disturbing contents of the book, Muslim Mafia: Inside the Secret Underworld that’s Conspiring to Islamize America, of “Islamophobia”, “racism”, and “bigotry” against Muslims; the fact remains that a growing, bi-partisan group of representatives has taken the first serious steps towards confronting CAIR. While CAIR strongly condemns the audacity of members of Congress calling for an investigation of CAIR based on Muslim Mafia's revelations, the simple fact remains that during all of CAIR’s false cries of victimhood, CAIR has not refuted one single charge or accusation made in the book.
Not one.
The reason is simple: CAIR realizes that it cannot defend against the truth. The Gaubatz team caught CAIR red handed and no amount of CAIR’s whining can hide or disguise the fact that CAIR is a terrorist supporting front group created to advance the interests of the Muslim Brotherhood and Hamas. Nothing CAIR’s liar-for-hire, “spokesman” Ibrahim Hooper can say will mitigate that fact that CAIR is here to convert our country into an Islamic theocracy; a theocracy that is not only not free, but oppresses every basic human right in the quest for world domination. A domination based on fear, terror, and the subjugation of those not among the “chosen few” who would eventually rule their version of an “Islamic paradise”.
CAIR’s ability to successfully manipulate the news media is testament to CAIR’s ability to utilize “useful idiots” in the media to further its agenda. Damning facts are consistently either avoided or disregarded by CAIR, and irresponsibly ignored by members of the media who lap up CAIR’s whimpers and ignore CAIR’s critics in the false belief that they are giving “voice to the voiceless”; not understanding that their deliberate silence as to the facts about CAIR are no different than giving aid and comfort to our enemies.
Long before "Muslim Mafia" (co-authored by Dave Gaubatz and Paul Sperry) was published, however, several members of Congress had warned of CAIR's disturbing origins. One of the first consistent and fearless critics of CAIR has been Democrat Senator Charles Schumer who said: "We know [CAIR] has ties to terrorism…intimate links with Hamas." Senator Schumer made these statements during a September 2003 Senate Judiciary Subcommittee on Terrorism, Technology and Homeland Security where the evidence against CAIR was laid out in detail. CAIR Executive Director Nihad Awad was invited to testify at this gathering, but chose to avoid the meeting and instead submitted a crude and absurd written statement listing CAIR's "accomplishments" and childishly attacking critics.
Senator Schumer continues to give unapologetic support in efforts to investigate and exclude CAIR from involvement in government programs, including "training" the FBI. In February of 2009, Senator Schumer joined Senators Kyl and Coburn in contacting the FBI to state their support for the FBI severing ties to CAIR saying "We certainly support that action..."
Democrat Senator Barbara Boxer has also called out CAIR. She recalled an award to CAIR's Basim Elkarra when she researched and learned of his involvement with CAIR and CAIR's ties to Hamas. In addition to recalling the award, Senator Boxer also told CAIR to remove her statement endorsing CAIR from their web site. CAIR blasted Senator Boxer saying her actions were rooted in "Islamophobia." Senator Boxer made clear her feelings about CAIR when she said: "To praise [CAIR] because they haven't been indicted is like somebody saying, 'I'm not a crook'"
When Representative Sue Myrick was joined by congressional colleagues and members of the Anti-Terrorism Caucus at a news conference to announce their request for the U.S. Department of Justice to investigate efforts by the CAIR to lobby congress illegally and place CAIR interns in sensitive agencies, CAIR thought they had an easy mark with eager media assistance to vilify these Republican representatives as "attacking Muslims" and deflect the attention away from the evidence of CAIR's dubious ties to terrorism. However, Sue Myrick founded the bipartisan Anti-Terrorism Caucus which consists of over 120 congressional members and includes Representatives Bud Cramer (D-AL), Kay Granger (R-TX), and Jane Harman (D-CA) who are the Caucus co-chairs. A Caucus statement demonstrates that CAIR is a problem for all Americans, not just an issue for one political party:
“Terrorists don’t target Democrats or Republicans. They target Americans, and this is why
we must face this issue as Americans. Members of Congress and the American public must
know the threats we face from radical jihadist terrorists. The Anti-Terrorism Caucus
will give Congress the tools and resources it needs to communicate those threats
to the public, as well as help them make more informed decisions when it comes
to terrorist issues.”
CAIR's "attacking Muslims" meme is their classic ploy to misdirect the issue away from CAIR's creation for supporting Hamas. Their documented defensive tactic of attacking the messenger because "the credibility of the message depends on the credibility of the messenger" is now in full operational mode. As soon as Myrick and her colleagues made their announcement, CAIR damage-control went into high gear issuing bleating media reports and having CAIR apologists appear on cue to falsely accuse the authors of "Muslim Mafia" and congressional members of being "anti-Islam" and "Islamophobes."
CAIR has pressed the narrative that author Gaubatz is "anti-Islam" and "anti-Muslim" even though the evidence shows the exact opposite is true. Gaubatz has risked his life helping Muslims, which includes leading a dangerous mission in 2003 to extract members of an Iraqi Muslim family out of Iraq who now affectionately call Gaubatz the "American Angel". Gaubatz has also come to the aid of Muslims under assault by CAIR.
The authors of "Muslim Mafia" make their intentions quite clear:
“This is not a book about Islam or about Muslims in general. It is about the threat known
from Shariah Islam and violent jihad propagated by a criminal class of Muslims
known as the Muslim Brotherhood or the ‘Ikhwan mafia’...”
Representative Myrick could not be more specific on who she is targeting:
“Why would anyone allow a group, who the FBI says is tied to terrorism, to influence
national security policy, or any policy for that matter?”...“If the FBI has cut ties
with CAIR, Congress should wake up and do the same.”
The gauntlet has been thrown and CAIR has, so far, refused to point out any parts of "Muslim Mafia" that are not true. This is further evidence, as if any was needed, that CAIR has once again been exposed as a dangerous organization that supports many who would be happy to kill us if they were given half a chance.
Members of the Congressional Anti-Terrorism Caucus have called for hearings. Now is the time for the Caucus to sit as a group and hold some hearings of their own, and once and for all give CAIR’s leadership the spotlight they crave; let CAIR explain away all the evidence compiled against them and just how they really defend “Muslim civil rights” in America.

CAIR And The Muslim Mafia
